In a case that is being compared to the Trayvon Martin shooting, a black man who shot and killed an unarmed man outside an Arizona restaurant is claiming self-defense.
On Tuesday, April 3, 2012, around 7:30 p.m., 29-year-old Daniel Adkins, who appears to be a white Hispanic male, was killed outside a Laveen, Arizona, Taco Bell at 7233 South 51st Avenue, near Baseline Road, said Phoenix police.
Authorities said the shooter, a 22-year-old black man, was pulling out of the Taco Bell drive thru when he crossed paths with Adkins, who was walking his dog on the sidewalk.

It's unclear if investigators found a weapon at the scene.
However, an independent eyewitness said Adkins swung his fist in the direction of the driver several times, according to various local news sources.
Like Florida, Arizona has a "Stand Your Ground" law, which allows a "victim" to use deadly force when faced with a life or death confrontation.
Thus far, the shooter has not been arrested or charged with a crime.
Adkins' family members are calling for justice.

DeleteThis makes me sick to hear about this incident. How can you read this and not see that Adkins was a victim of a terrible crime. The killer should be arrested and tried for deliberate homicide. 'the ' 'stand your own ground' law should not be considered for this appalling and infelicitous act. This country is going to destroy itself with these gun laws. It's incidents like this one that we need to have stricter gun laws and more control on who own them. My prayers go out to the family and friends who have suffered for their loss.

So the question is, with all of these similarities, why has there been such media outrage about one case while the other case is hardly mentioned? Because of the media coverage- the family members of Trayvon will at least have a chance in court; however, the family of Daniel will have no such chance because the media has chosen not to touch the story.

Trayvon Martin is tragic- Daniel Adkins is tragic- but what about all of the of the kids, men, and women that are killed everyday and not ever mentioned? This whole situation illuminates the medias dangerous bias and political charge- don't be tricked by it, and although these anecdotal situations may be extremely easy to get caught up in; you have to realize that people will do anything to attract public support for their cause, even exploit a tragic racially charged shooting.
Sounds like the Black thug was probably high on something, driving recklessly, almost running over the victim. This caused the victim to probably yell at him which escalated to this result. Two people fight. One shoots the other. Self-defense is a decision a jury should make...Always. KEEP MARCHING FOR JUSTICE AND THE REPEAL OF THIS LAW. Race is irrelevant here. At least it should be. It has been a week now and the man has not been arrested. This man shot my cousin over words!!! This has nothing to do with white, black, Hispanic, or otherwise. This is about a cold blood murder. Daniel was simply walking his dog. The man was in a car, he could have drove away. My cousin had no weapon on him and the man shot him with a .40 caliber weapon. That is not self defense!!!! That is cold blooded murder. We had my cousins funeral on Easter Day while this man sat at home celebrating with his family. This had been a great tragedy in our family. What happens when children start taking this stuff to heart. What happens when your kid feels threatened by the neighbor kid because he yelled at him and shoots him. Its self defense isnt it. The kid felt threatened. Is this really the world we want our children to grow up in? I dont think so.

ReplyDeleteThere is usually a sign when exiting the drive thru to "watch out for pedestrians". Most people walking aren't cognize they are even crossing in front of car because there is no visibility for them. You step from around the corner directly into the drive through lane. The driver should have been paying closer attention as to not hit someone with a blind spot. After saying all of that, it isn't worth taking someone's life over. So what if the pedestrian had words with the driver. It is best to drive away if you can. Now look what he is dealing with now. Even if he isn't charged, he still has to live with the fact he took another's life over BS. If the driver doesn't care, I am sure someone in his life does.. I would if my son did something like this, it would bother me and I would have hoped he would have just driven away especially if there was no harm done to him or his vehicle.

One never knows..read the story about the group of guys who called the Denver police 911, was told to return to the city limits or they would get no assistance. ReplyDeleteIt's very sad. But, we need to remember to let the Judicial system run its course. It doesn't always get it right, but I believe it gets things right more often than it gets it wrong. Much of the problem right now is that the news media (both liberal and conservative) jump to a conclusion that supports their agenda and try these cases in the court of public opinion.
ReplyDeleteAlso, I honestly feel you will start to see this type of thing happen more often as law abiding citizens feel less and less protected by the police and more and more threatened by the lawless. So, they are starting to take steps to provide self protection. Until the criminal element in our society start to fear what might happen if they attack an average person, unfortunately, these types of stories will probably increase. When I was trained in law enforcement, one of the things they they trained us in was that just because someone is "unarmed", doesn't mean they aren't deadly if they decide to attack.

Race should not be an issue in this case or in the Trayvon case. The issue is that in both cases is that an unarmed man was shot by an armed man and neither was arrested because it was "self defense". This is a dangerous game we are playing where anyone can shoot anyone else and claim self defense and guess what the only other witness is dead so I guess we'll take your word for it. What all of these racist morons don't seem to get is that the only reason any of us have ever heard of Trayvon Martin is because the police did not hold Zimmerman, they sent him home with the gun he used to kill Trayvon. If he had been arrested there would have been no major story outside of Sanford. Unless there is overwhelming evidence of self defense like multiple credible witnesses, a video or something along those lines it's probably a good idea to arrest someone who just shot someone who is unarmed. Gather the facts, give them a fair trial and let the justice system do it's job. As for all of you clowns who think the justice system goes easy on blacks why don't you look up the percentages of blacks who are incarcerated or on death row.

There is no way a person's life was threatened, when he could have just driven away or even roll-up his window. Similarly, George Zimmerman, in refusing to comply with the 911 operator's instructions to stop pursuing Martin, was active in escalating the situation.
ReplyDelete"Stand your ground" means you do not have a presumption of guilt just because you did not flee, or look for every attempt to flee. In all cases there must be felonious, great bodily harm, in the process of being committed (or an abduction, which is presumed to lead to such). These cases are tragedies. And, innocent and guilty alike might try to use laws such as these for protection , rightly or wrongly. It is up to the Police & Prosecutors to take evidence and determine if there is enough to move toward indictment.
What these cases prove is that the Police & Prosecutors require our attention. And, occasionally they need to hear our voices. They need to know what they do & don't do is noted by the public, and will be increasingly scrutinized as they deviate from the proper enforcement of laws, and the public's expectations of Justice.
I have seen very little (none) national news coverage of this case. But, I expect this will change, as I have seen many postings on this subject just recently across quite a few sites.
If not, we might have to start a dog walking march in Laveen, Arizona!
Why hasn't this made national news like the Zimmerman/Martin case? Why isn't there any rallies/marches from white people? Why isn't there any media outrage? ReplyDeleteYou can't claim self-defense when you're in a car and your victim is a pedestrian. If he really was being aggressive, you could easily drive away. Can we stop making this about race, if there was no evidence that this crime was racially-motivated? Two people of different races are involved in a shooting. That's not a whole lot in common! Trayvon Martin was targeted and physically pursued on account of his skin by an armed neurotic with a history of racial mistrust. This just sounds like road-rage, or general anti-social decay that pervades our society. However, we need to get the facts and hear the witness testimony. Otherwise, it's just hot air.

We are talking about a man losing his life. The murderer deserves to face the consequences of his crime. I am usually all for self-defense, but shooting someone for hitting your car is certainly not self-defense. It's murder.

ReplyDeleteThis shooter could be innocent, Zimmerman could be guilty, the public doesn't have the facts...and shouldn't have them. We have no business getting involved in particular cases. Let the police and prosecutors do their job. Forcing their hand into a premature prosecution may let a guilty man go free and causes irreparable harm to an innocent one. Victim's families have waited years on technology, and confessions to estranged friends, to get their rightful verdict. Remember, you only get one shot at it. It is worth waiting for.
If you want to advocate for a particular change in the law, great! Just don't get involved in particular cases.
If race has anything to do with any case, you need to look in the mirror and take a good look at a rascist.

This is not a case of why Daniel was walking down the street, why does Daniel or anyone else have to have a reason to walk down the street, this is America still last time I checked. The real question here is why did the driver simply not drive away if he really felt threaten, and how does the stand your ground law even fit into this, the law is pretty clear cut and says if you are in danger of death or bodily harm then you are allowed to use deadly force, the driver was not in any real danger, I mean what did he think Daniel was going to do yell at him to death. I support the right to defend yourself and own guns myself, but in this case it was just a bad choice by the police not to arrest or even release the shooters name, Daniel's shooter is a murderer and needs to be locked up. Look people just because someone yells or screams at you that is not a reason to kill them, and it's the hot heads like Daniel's killer who give all gun owners a bad name.
